RULES AND REGULATIONS
Tickets will not be sold past 4:30 p m, February 16, 2014; however, tickets may sell out before this time. The accounting firm of Beach Fleischman PC will supervise the drawing. The winner need not be present to win. The Early Bird prize drawing will be after November 23, 2013. The drawings for the 2014 Dream Raffle (herein referred to as “Raffle”) prize winners will be announced on Saturday, February 22, 2014.
More than one name may be entered on the ticket to indicate that any prize won is to be shared. Only the names provided on the ticket will be eligible to receive prizes. Entries by mail or in person will be accepted at 140 N. Main Ave, Tucson, AZ 85701 and/or at Tucson Symphony Center, 2175 N Sixth Ave, Tucson, AZ 85701. Entries must include payment by cash, check or credit card to be eligible. You may also call (520) 882-8585 or (520) 624-2333, or fax to (520) 624-7202 with your VISA, MasterCard, Discover or American Express number and expiration date to purchase a ticket. Or you may complete your ticket purchase online at www.tucsonsymphony.org or www.tucsonmuseumofart.org. You may purchase as many available tickets as you wish. All sales transactions are final. No payments will be refunded. The Tucson Museum of Art (TMA) and Tucson Symphony Orchestra (TSO) reserve the right to reject any entry form that is submitted with payment that does not constitute “good funds.” The TMA and TSO assume no responsibility for lost, late, misdirected or non-delivered mail.
Only 20,000 tickets will be sold at two price points: single tickets for $150 and 3-packs for $375. Entries received after multi-pack tickets are sold out or more than 20,000 tickets have been sold will be returned to the requesting entrant.
To be eligible to participate in the TMA and TSO Members Drawing, the ticket buyer must be a current (non-expired) member of the TMA and/or a current subscriber or donor of the TSO at the time of the drawing. Status will be verified at the time of the drawing.
Final Drawing – Grand Prize
A minimum of 7,000 tickets must be sold for the Grand Prize winner to have the choice of the $400,000 cash option or the $500,000 buyer’s credit with Maxx Builders Custom Homes. If fewer than 7,000 tickets are sold by 4:30 pm on February 16, 2014, the “Raffle” will be held as scheduled and all prizes will be awarded as advertised with the exception that the Grand Prize winner will receive a 50% share of the net “Raffle” proceeds. Net “Raffle” proceeds are defined as the balance of funds left after paying all “Raffle” expenses. Net proceeds will be divided evenly between the Tucson Museum of Art, the Tucson Symphony Orchestra, and the grand prize winner, less appropriate and required federal taxes.
If 7,000 tickets or more are sold, the winner will have the choice of receiving the prize as the $400,000 cash option or the $500,000 buyer’s credit with Maxx Builder Custom Homes. The Grand Prize winner must make their election in writing before 12:00 pm on March 1st, 2014. If the grand prize winner fails to make the election by this deadline, he or she will be deemed to have elected the cash option.
Final Drawing 2nd Prize –
The Second Prize winner has the option of receiving a Jaguar XF (with the TSO paying Royal Jaguar the MSRP, plus additional features or options for the selected vehicle, up to and not to exceed $50,875, excluding all related purchase fees and taxes) or $35,000 cash (paid by the TSO). If the Second Prize winner elects to take the offered automobile, the Second Prize winner assumes responsibility for all related purchase fees and taxes, as well as additional options or features beyond the $50,875 maximum to be paid by the TSO.
If the vehicle is chosen and subsequently returned to Royal Jaguar, any amount in excess of $35,000 of the purchased vehicle price provided by the TSO up to the $50,875, will be refunded directly to the TSO. Value of the vehicle is based on the automobile manufacturer’s suggested retail price (MSRP) provided by manufacturer. If electing to take the automobile, the Second Prize winner is required to remit Federal tax withholding to the Tucson Symphony Orchestra prior to delivery of vehicle (calculated at 25% of MSRP) which will be sent to the IRS on the winner’s behalf. Should the Second Prize winner elect to take the automobile, but wish to obtain a different model from the dealership, the Second Prize winner will be responsible for any additional costs associated with the purchase of the other model; if a vehicle with a lesser MSRP is selected, the TSO will pay the dealership for the cost of the automobile up to the $50,875, but will not reimburse the difference to the Second Prize winner. There is no guarantee that the Second Prize winner can sell their car for list price. If the Second Prize winner elects to take the $35,000 in cash, 25% will be withheld by the TSO and sent to the IRS on their behalf.
By entering this “Raffle,” entrants accept and agree: (i) to be bound by these rules, limitations and restrictions and by the decisions of the Tucson Museum of Art and Tucson Symphony Orchestra; and (ii) their names and likenesses may be disclosed to and used by the news media and may otherwise be used by the TMA and/or TSO for publicity purposes. Other rules and regulations may apply. Please contact the TMA or TSO for additional information.
Anyone 21 years of age or older may enter, excluding employees of the Tucson Museum of Art and Tucson Symphony Orchestra, their spouses, or dependents. Entry purchaser must be present in the state of Arizona at the time of entry purchase. It is not necessary to be a resident of the state of Arizona, but one must be physically present in Arizona at the time of entry purchase. You must purchase your ticket in Arizona, but you do not have to live in Arizona. An affidavit of eligibility may be required from the prize winner. The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar drawings for valuable prizes are not gifts, and therefore do not qualify as deductible charitable contributions. The chances of winning are based on the number of tickets sold. If fewer tickets are sold, the odds of winning the Tucson Museum of Art and Tucson Symphony Orchestra Dream Raffle increase.
The buyer’s credit with Maxx Builder Custom Homes is good towards the purchase contract to build a home on a specified Maxx Builder Custom Home lot or a lot of your choice, pending availability. The Tucson Museum of Art does not provide any guarantee or warranty, expressed or implied, in connection with the House and accepts no liability or responsibility regarding the construction of the House.
If the winner elects the cash prize the appropriate and required federal taxes will be withheld by the Tucson Museum of Art and Tucson Symphony Orchestra in accordance with federal law and the balance of the cash prize will be remitted to the winner. If the winner elects the buyer’s credit with Maxx Builder Custom Homes the winner assumes all fees, financing costs (including, but not limited to, closing costs and title insurance). Tucson Museum of Art will remit the tax withholding to the United States Department of Revenue on the winner’s behalf for all cash prizes.
As mentioned above, federal law requires that corresponding tax withholding of 25% on prize values of $5,000 or greater must be collected from winners upon award and distribution. Tax form W-2G will be filed on the winner’s behalf in addition to withheld taxes. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time prizes are claimed will be followed.

- · Final Drawing – Entries will be accepted until 4:30 pm on February 16, 2014.
- · Members and Subscribers Only Drawing – Entries will be accepted until 4:30 pm on February 16, 2014.
After the Early Bird Drawing, the winner’s entry ticket will be returned for the subsequent Final Drawing. All winners of prizes will continue to have the opportunity to win subsequent prizes, including the Grand Prize.
To be eligible to participate in the Members and Subscribers Only Drawings, the ticket buyer must be a current (non-expired) member of the TMA at the time of purchase or current subscriber/eligible donor of the Tucson Symphony Orchestra. Status will be confirmed by TMA and TSO staff prior to entry ticket being entered in the drawing.
