Dream Home Raffle Official Rules

The grand prize drawing for the 2012 Dream Home Raffle (herein referred to as “Raffle”) will be held April 26, 2012 at 6:00pm at the Tucson Museum of Art.  Tickets will not be sold past 5:30pm, April 26, 2012, however, tickets may sell out before this time.  The accounting firm of Beach Fleischman PC will supervise the drawing.  Though the drawing will be open to the public, you do not have to be present to win. 

Tickets are $150 each.  More than one name may be entered on the ticket to indicate that any prize won is to be shared.  Only the names provided on the ticket will be eligible to receive prizes.  Entries by mail or in person will be accepted at 140 N. Main Ave, Tucson, AZ 85701 and must include payment by cash, check or credit card to be eligible.   You may also call (520) 624-2333 or fax (520) 624-7202, with your VISA, MasterCard, Discover or American Express number and expiration date to purchase a ticket.  Or you may complete your ticket purchase online at www.TucsonMuseumofArt.org/DreamHome.  You may purchase as many available tickets as you wish.  All sales transactions are final.  No payments will be refunded.  The Tucson Museum of Art reserves the right to reject any entry form that is submitted with payment that does not constitute “good funds.”  The Tucson Museum of Art assumes no responsibility for lost, late, misdirected or non-delivered mail.

A maximum of 9000 tickets will be sold.  The chances of winning are based on 6500 tickets, which is the average number of tickets sold over the last 5 years.  If fewer tickets are sold, the odds of winning the grand and other prizes increase.  The IRS has taken the position that amounts paid for chances to participate in raffles, lotteries or similar drawings for valuable prizes are not gifts, and therefore do not qualify as deductible charitable contributions.  Offer void where prohibited by law.

If the grand prize is awarded, the winner will have the choice of receiving the prize in the form of $400,000 in cash or receiving a $500,000 buyer’s credit with AF Sterling Homes.  The grand prize winner must make an election in writing between the buyer’s credit and the cash before 12:00 noon May 3, 2012; if the grand prize winner fails to make the election by this deadline, he or she will be deemed to have elected the cash option.  If the winner elects the cash prize the appropriate and required federal taxes will be withheld by the Tucson Museum of Art in accordance with federal law and the Tucson Museum of Art will remit the balance of the cash prize to the winner.  If the winner elects the buyer’s credit with AF Sterling Homes the winner assumes all fees, financing costs (including, but not limited to, closing costs and title insurance) and at the time of closing is responsible for paying all state and federal income taxes. Tucson Museum of Art will remit the tax withholding to the United States Department of Revenue on the winner’s behalf.

The buyer’s credit with AF Sterling Homes is good towards the purchase contract to build Model 3541 on a lot at Tortolita Vistas with a lot premium of up to $30,100.  This credit does not apply to pre-built or speculative houses in the inventory of AF Sterling.  Any unused portion of the credit will be forfeited by the winner.  The Tucson Museum of Art does not provide any guarantee or warranty, expressed or implied, in connection with the House and accepts no liability or responsibility regarding the construction of the House.

A minimum of 6500 tickets must be sold for the grand prize winner to have the choice of the $500,000 buyer’s credit or $400,000 in cash.  If fewer than 6500 tickets are sold by 5:30pm on April 26, 2012, the “Raffle” will be held as scheduled and all prizes will be awarded as advertised with the exception that the grand prize winner will receive a 50% share of the net “Raffle” proceeds.  Net “Raffle” proceeds are defined as the balance of funds left after paying all “Raffle” expenses.  Net proceeds will be divided evenly between the Tucson Museum of Art and the grand prize winner, less appropriate and required federal taxes. 

By entering this “Raffle”, entrants accept and agree (i) to be bound by these rules, limitations and restrictions and by the decisions of the Tucson Museum of Art, and (ii) that their names and likenesses may be disclosed to and used by the news media and may otherwise be used by the Tucson Museum of Art for publicity purposes.  Other rules and regulations may apply.  Please contact the Tucson Museum of Art for additional information.

Anyone 21 years of age or older may enter, excluding employees of the Tucson Museum of Art, their spouses and children.  An affidavit of eligibility may be required from the prize winner.
